Terms of Service for Real Estate Back Ops, LLC (doing business as “FIJI Insights”).

These Terms of Service (“Terms”) govern your access to and use of FIJI Insights, a reverse marketplace and valuation platform for real estate brokerages. By creating an account, using our services, or accessing our website, you agree to be bound by these Terms. If you do not agree, please do not use FIJI Insights.

1. Eligibility and Accounts

You must be at least 18 years old and legally capable of entering into a binding contract to use FIJI Insights. You are responsible for the accuracy of the information you provide during registration and for keeping your account credentials secure. You are responsible for all activity that occurs under your account.

2. Description of Services

FIJI Insights provides tools for real estate brokerages to value their business, surface insights, list themselves anonymously on a reverse marketplace, and build verified buyer profiles. Some features are free; others require a paid subscription. We may add, modify, or discontinue features at any time.

3. Subscriptions and Payments

Paid subscriptions are billed in advance on a recurring basis (monthly or yearly, depending on the plan you choose). Subscription payments are processed by Stripe; by subscribing, you also agree to Stripe's terms of service. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.

You can manage, change, or cancel your subscription at any time from the Stripe Customer Portal, accessible through your Account Settings. Cancellations take effect at the end of the current billing period; we do not provide refunds for partial periods except where required by applicable law.

Failed renewal payments may result in your subscription being placed in a past-due state and, ultimately, in loss of access to paid features.

4. Acceptable Use

You agree not to: (a) use FIJI Insights for any unlawful purpose; (b) misrepresent your identity, your brokerage, or your buyer profile; (c) attempt to gain unauthorized access to our systems or other users' accounts; (d) interfere with or disrupt the integrity or performance of the platform; (e) scrape, crawl, or otherwise extract data from the platform without our written permission; or (f) use the platform to send unsolicited communications or spam other users.

5. User Content

You retain ownership of the content you submit to FIJI Insights (including brokerage details, valuation inputs, and buyer profile information). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and process that content as needed to operate and improve the platform.

You represent that you have all rights necessary to submit your content and that it does not infringe any third-party rights or applicable laws.

6. Intellectual Property

FIJI Insights, including its branding, valuation methodology, Insights^™, MarketPlace^™, and related software, is owned by Real Estate Back Ops, LLC. Nothing in these Terms grants you any right or license to our trademarks, logos, or proprietary algorithms except as expressly permitted by us.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy, available at /privacy. By using FIJI Insights, you agree to the terms of the Privacy Policy.

8. Termination

We may suspend or terminate your account at any time if you violate these Terms, abuse the platform, or pose a risk to us or other users. You may close your account at any time by contacting us. Upon termination, your right to access the platform ends, and paid subscription periods may not be refundable except where required by law.

9. Disclaimers

FIJI Insights is provided “as is” and “as available” without warranties of any kind, either express or implied. Valuation results and insights are estimates based on the data you provide and our methodology; they do not constitute financial, legal, tax, or investment advice. You should consult a qualified professional before making any business decision based on information from the platform.

10. Limitation of Liability

To the maximum extent permitted by law, Real Estate Back Ops, LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of FIJI Insights. Our total liability for any claim arising out of or related to these Terms will not exceed the amounts paid by you for the service in the twelve months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of FIJI Insights will be resolved in the state or federal courts located in Maricopa County, Arizona.

12. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and revise the “Last updated” date above. Material changes will be communicated to active users via email or an in-app notice. Continued use of FIJI Insights after the changes take effect means you accept the updated Terms.
